Terms of Service (ToS)

1. Preamble and Purpose of the Terms of Service

The purpose of these Terms of Service (hereinafter referred to as "ToS") is to define the terms, conditions, and limits under which the easyopti platform (hereinafter "the Service" or "the Application") is made available to its users, whether professionals (B2B) or individuals.

Use of the easyopti platform implies full, complete, and unreserved acceptance of these ToS. If you do not accept these terms, please do not use our optimization tools. easyopti reserves the right to modify these terms at any time, with modifications taking effect upon publication on the website.

2. Technical Architecture and Service Access

easyopti stands out through an innovative technical architecture known as "Zero-Server" or "Local-First". Mathematical optimization algorithms (solvers) are compiled into WebAssembly and run directly in the RAM of your web browser (Chrome, Firefox, Safari, Edge).

Consequently, accessing the service requires hardware (computer, tablet) with sufficient processing power and memory, as well as a recent, up-to-date web browser. The publisher cannot be held liable for slowness or calculation failures resulting from obsolete user hardware or the use of an incompatible browser.

Once the application is loaded, most features can be used offline. An internet connection is only required for the initial loading of the application, authentication, and the use of the optional Cloud backup feature.

3. Registration, User Account, and Security

Basic use of the schedule generator can be done anonymously, without creating an account. In this case, data is stored solely in your browser's local database (IndexedDB). If you clear your browser cache, this data will be permanently lost.

To benefit from multi-device synchronization and secure backups, users may create an account. The user agrees to provide accurate information upon registration and is solely responsible for maintaining the confidentiality of their login credentials.

Any action performed from the user's account is deemed to have been carried out by the user. In the event of loss, theft, or fraudulent use of their credentials, the user must immediately inform the easyopti team.

4. Intellectual Property and User License

All elements comprising the easyopti platform, including but not limited to source code, operational research algorithms, WebAssembly modules, graphical interfaces, text, logos, and databases, are the exclusive property of the publisher and are protected by international intellectual property law.

The publisher grants the user a personal, non-exclusive, non-assignable, and non-transferable right to use the application, strictly limited to their own internal business needs.

Users are strictly prohibited from engaging in any form of reverse engineering, decompilation, disassembly of WebAssembly modules, or attempting to extract the source code of the optimization algorithms. Any unauthorized reproduction, representation, or commercial exploitation of the platform will result in immediate legal action.

5. Publisher Liability and Limitations

easyopti is a Decision Support System. Although our algorithms are designed to incorporate legal constraints and generate optimized schedules, the results provided by the application are for purely indicative and advisory purposes.

It is the sole responsibility of the user (employer, manager, healthcare supervisor, store manager) to verify and validate that generated schedules comply with applicable labor laws in their country, collective agreements, and individual employment contracts.

Under no circumstances shall easyopti, its creators, or its partners be held liable for direct or indirect, material or immaterial damages (such as labor disputes, administrative penalties, operating losses, or data loss) resulting from the use or inability to use the service, or from an error in the generated schedules.

6. Service Modifications and Pricing

During its launch phase, access to easyopti optimization modules is offered free of charge. The publisher reserves the right to modify this pricing policy in the future, particularly through the implementation of modular subscriptions (Freemium or Pay-per-use model).

Any price changes will be clearly communicated to registered users in advance. Users will then be free to accept the new terms or stop using the service and export their data.

7. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with French law. In the event of any dispute regarding the interpretation, validity, or execution of these Terms, and failing an amicable settlement between the parties, the French courts shall have exclusive jurisdiction.
